{"id":4618,"date":"2018-04-11T14:42:26","date_gmt":"2018-04-11T19:42:26","guid":{"rendered":"https:\/\/www.figmarketing.com\/blog\/?p=4618"},"modified":"2022-04-21T10:28:46","modified_gmt":"2022-04-21T15:28:46","slug":"compliance-corner-dol-fiduciary-rule-update-and-industry-news","status":"publish","type":"post","link":"https:\/\/www.figmarketing.com\/blog\/compliance-corner-dol-fiduciary-rule-update-and-industry-news\/","title":{"rendered":"Compliance Corner: DOL Fiduciary Rule Update and Industry News"},"content":{"rendered":"<p>Some of us have seen the stories and read the news regarding the DOL\u2019s fiduciary rule and the Fifth Circuit Court of Appeals <strong><a href=\"http:\/\/www.investmentnews.com\/article\/20180315\/FREE\/180319947\/fifth-circuit-court-of-appeals-vacates-dol-fiduciary-rule\" target=\"_blank\" rel=\"noopener noreferrer\">decision to vacate the rule<\/a><\/strong>.<\/p>\n<p>This result was certainly a welcome surprise for our industry, but there are things you should know about this ruling: First and foremost, the rule still exists! The ball is currently in the DOL\u2019s court and they can decide to appeal this ruling, or to back away and accept it.<\/p>\n<p>If the DOL appeals, we\u2019ll have to wait for the next court\u2019s decision. If the DOL decides not to press forward legally, the ruling should stand.<!--more--><\/p>\n<p>At this time, you\u2019re still required to complete the appropriate disclosures prior to the sale. While the DOL has said it will not enforce the rule at this time, we should look to see what states like Massachusetts are doing to ensure enforcement.<\/p>\n<p>Massachusetts has <strong><a href=\"http:\/\/www.wealthmanagement.com\/regulation-compliance\/massachusetts-charges-scottrade-violating-dol-rule\" target=\"_blank\" rel=\"noopener noreferrer\">accused Scottrade of violating the rule<\/a><\/strong>, which could start a trend in various states pushing their own agendas. Ultimately, most believe this entire topic has always belonged in the SEC\u2019s wheelhouse.<\/p>\n<p>In fact, the SEC is quickly working on their own version of a fiduciary rule. Some <strong><a href=\"http:\/\/www.investmentnews.com\/article\/20171004\/FREE\/171009978\/sec-chief-jay-clayton-tells-lawmakers-agency-is-drafting-its-own\" target=\"_blank\" rel=\"noopener noreferrer\">news outlets have reported<\/a><\/strong> that the SEC should have a draft version of their rule at some point this summer \u2013 or maybe sooner. We\u2019ll keep you up-to-date on any further developments.<\/p>\n<hr>\n<p>In other news, our carrier partners often provide us with various news articles from around the industry on a variety of topics. But, below are more stories you can read that\u2019ll show you the seriousness state insurance commissioners have with regards to elder financial abuse.<\/p>\n<ol>\n<li>The Oklahoma Insurance Department is now offering free seminars to teach seniors about the latest scams that are being used by certain \u201cbad actors\u201d:<br><strong><a href=\"http:\/\/kfor.com\/2018\/02\/16\/insurance-department-hosting-free-seminars-to-warn-seniors-about-latest-scams\/\" target=\"_blank\" rel=\"noopener noreferrer\">Insurance Department Hosting Free Seminars to Warn Seniors About Latest Scams<\/a><\/strong><\/li>\n<\/ol>\n<ol start=\"2\">\n<li>A Wisconsin court is requiring an insurance agent to give up $1million received after being named a beneficiary of an elderly client\u2019s policies.<a href=\"https:\/\/www.jsonline.com\/story\/news\/local\/2018\/03\/07\/insurance-agent-should-give-up-1-million-received-clients-policies-judge-recommends\/399695002\/\" target=\"_blank\" rel=\"noopener noreferrer\"><br><strong>Insurance Agent Should Give up $1 Million Received from Client\u2019s Policies, Judge Recommends<\/strong><\/a><\/li>\n<\/ol>\n<ol start=\"3\">\n<li>In California, an insurance agent was denied parole for his acts in elder abuse.<br><strong><a href=\"http:\/\/www.crimevoice.com\/2018\/01\/30\/94788\/\" target=\"_blank\" rel=\"noopener noreferrer\">No Parole for Former Embezzling Insurance Agent<\/a><\/strong><\/li>\n<\/ol>\n<ol start=\"4\">\n<li>Also in California, an insurance agent finds himself in jail for the next 9 years for defrauding seniors.<a href=\"http:\/\/www.sandiegouniontribune.com\/news\/courts\/sd-me-fraud-sentencing-20180307-story.html\" target=\"_blank\" rel=\"noopener noreferrer\"><br><strong>Insurance Fraud of $1.4 Million Lands Agent in Prison for 9 Years<\/strong><\/a><\/li>\n<\/ol>\n<p>When working with senior investors, you should take great care to ensure recommendations are well-documented. It\u2019s good practice to have family members of elderly customers attend meetings (this too should be documented).<\/p>\n<p>As our country\u2019s population ages, these stories will likely increase and give our industry a black eye.
